Biometric Data Notice

By using the A.M. HR platform, you explicitly consent to the collection and processing of your facial biometric data for the purpose of identity verification and attendance tracking. This data is handled in strict compliance with the Philippine Data Privacy Act of 2012.

1. Acceptance of Terms

By accessing or using the A.M. HR Smart HRIS ("the Platform"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Biometric Recognition & Consent

The Platform uses advanced facial recognition technology to prevent "Buddy Punching" and ensure payroll integrity.

  • Data Collection: We capture a mathematical representation of your facial features (facial template).
  • Usage: This data is used solely to verify your identity during clock-in/out events.
  • Retention: Biometric data is stored securely and is deleted upon the termination of your employment or the client's subscription, unless required by law.

3. Privacy & Data Protection (DPA 2012)

We are committed to protecting your personal information in accordance with the Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012.

  • We implement administrative, physical, and technical security measures to protect your data.
  • We will never sell your personal or biometric data to third parties.
  • The Data Controller is your Employer (the Client), and the Platform Provider acts as the Data Processor.

4. User Responsibilities

Users are responsible for maintaining the confidentiality of their login credentials. Any activity under your account is your responsibility. You agree not to:

  • Attempt to circumvent the biometric security (e.g., using photos or masks).
  • Access the system using another person's credentials.
  • Use the Platform for any fraudulent or illegal activity.

5. Service Availability & Liability

While we strive for 99.9% uptime, the Platform is provided "as is." We are not liable for any payroll discrepancies caused by user error, hardware failure, or internet connectivity issues on the client's side. Employers are advised to perform final audits of all DTR and Payroll reports generated by the system.

6. Subscription & Termination

Clients agree to the subscription terms (PEPM - Per Employee Per Month) as outlined in their service agreement. Failure to settle fees may result in the temporary suspension of access to advanced modules (Payroll, AI Assistant, etc.).

7. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of the Philippines.
